Terms of Use

What the information on this site is, what it is not, and how engineering work is actually engaged. The short version: everything here is general, this site is written with AI assistance, and no flood study fits a site it was not written for.

About these terms

This website is published by Fiord Group Pty Ltd (ACN 700 387 391, ABN 11 700 387 391). By using the site you accept these terms. If you do not accept them, please do not use the site.

The information here is general

Everything published on this site — including the Insights articles, the service pages and the service-area pages — is general information about hydrology, flood engineering and the Western Australian approvals framework. It is written carefully and sourced, but it is written without knowledge of your site, your catchment, your proposal or your approval pathway.

General information is not a hydrological assessment, a flood study, a design, or engineering advice for any particular project. Catchment behaviour, flood risk and regulatory requirements are highly site-specific, and guidance that is correct in general can be wrong for a given site. Do not rely on anything on this site as a substitute for a site-specific assessment by a suitably qualified engineer.

No engineering relationship is created by this site

Reading this site, emailing us, or calling us does not create a client relationship and does not engage us to perform professional services. We take on work only under a written proposal or engagement accepted by both parties, which sets out the scope, the standards and methods to be applied, the deliverables, the limitations and assumptions, and the terms on which the work is provided.

Where those engagement terms differ from anything on this site, the engagement terms apply.

Regulatory references may change

Content on this site refers to legislation, standards, policies and agency guidance — including Australian Rainfall and Runoff, State Planning Policy 2.9, and material issued by DWER and the EPA in Western Australia. These change, and guidance is periodically superseded, renamed or withdrawn.

Articles carry their sources so you can check the current position at the primary source. We update content as we become aware of changes, but we do not warrant that every reference is current at the time you read it.

How we use AI

This website is produced with AI assistance. The page copy and the Insights articles are drafted with these tools and edited by us against source material and primary references. We use the same tools elsewhere in the practice’s work, within a process that keeps the judgment, the checking and the responsibility with us.

Sources are cited throughout so that a claim can be traced back to the instrument or dataset it comes from. Even so, no review catches everything, and published guidance is superseded from time to time between writing and reading — so anything we publish or issue may contain an error. Where a statement bears on a decision, check it against the primary source or ask us to confirm it in writing. That is ordinary good practice on any project, and we would rather be asked.

None of this reduces what we are responsible for. Work performed under a written engagement is delivered to the standard required of us and on the terms of that engagement, and nothing in this section limits any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

If you find an error in anything we have published or issued, tell us and we will correct it.

Selected Projects and professional experience

The projects shown on this site were delivered by the principal, Blake Marxsen, across prior professional roles and through Fiord Group Pty Ltd. This is stated on the Work section itself and is repeated here so it is unambiguous: not every project listed was performed by Fiord Group Pty Ltd as the contracting entity.

Client, proponent, employer and asset names are deliberately not published anywhere on this site, and locations are given at region level where naming a locality would identify a project. Where a project involved a wider team, the work described is the work the principal personally led or delivered.

Endorsements shown on this site were given by named-by-role people at previous employers and comment on professional work rather than on Fiord Group Pty Ltd as an entity. They are attributed by role and sector only, at those people’s reasonable expectation of privacy.

Professional credentials

Blake Marxsen is a Member of Engineers Australia (MIEAust) and holds a Bachelor of Engineering (Environmental) with Honours from Murdoch University. Where a project requires a registered or chartered engineer — for example a jurisdiction operating a statutory registration scheme for professional engineers — we will say so and arrange appropriately registered involvement rather than proceed without it.

Intellectual property

The content of this site, including text, images, diagrams and design, is owned by Fiord Group Pty Ltd or used under licence, except where otherwise credited. Stock photography is used under the Unsplash Licence. Typefaces are used under the SIL Open Font Licence.

You may read, quote and link to this site with attribution. You may not republish substantial portions of it as your own.

Liability

To the extent permitted by law, we exclude liability for any loss arising from reliance on information published on this site. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Liability for professional services we are engaged to perform is dealt with in the engagement terms for that work, not here.

This site links to agency, legislative and standards sources. We do not control those sites and are not responsible for their content or availability. A link is not an endorsement.

Governing law

These terms are governed by the laws of Western Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
